When hiring for an open position, the branch manager of Intermountain Trust Bancorp was challenged with an ethical dilemma he was not anticipating. An internal applicant challenged the hiring manager's ethical values by insisting that their friendship and other external employment factors be taken into consideration in the hiring decision. This is a classic case of a candidate using undue influence1 to manipulate a colleague and gain employment. In what started as a routine decision, the manager was faced with an (...) unforeseen ethical quagmire. This case describes a real situation that had local impact on the stakeholders of a regional bank, and provides a true example of the types of difficult situations that can affect candidate selection in hiring decisions. Using the analytic framework of normative logic presented in Fisher, Lovell, and Valero-Silva, provided here are five original business ethics mini-cases that may be used to teach and practice case analysis. We have taken the six questions that are used in the analytic framework of normative logic to solve ethical problems and have adapted them to seven steps that can be applied to conflict resolution of mini-cases in class. Then the adapted normative logic model has seven steps: Describe the “fundamental (...) needs of humankind” as they relate to the case, e.g. caring, supporting, reciprocity, fairness, trust; Explain the established norms, values, and laws that can be seen to apply in this case; State in brief the facts of the situation; Examine the network of circumstances that preceded the situation ; Generate at least three alternative positions and actions open to the actor in the case; Speculate on the hypothesized consequences of the different positions or actions the actor in the case may take; and Choose among the alternative positions the actor in the case might take and give your informed and judged reason for making that choice. A suggested answer is provided for one case, which could be reproduced as a class handout for students to examine after having done their own analysis and having discussed the case as a class. ABSTRACT:Neuroethics, the study of the cognitive and neural mechanisms underlying ethical decision-making, is a growing field of study. In this review, we identify and discuss four themes emerging from neuroethics research. First, ethical decision-making appears to be distinct from other types of decision-making processes. Second, ethical decision-making entails more than just conscious reasoning. Third, emotion plays a critical role in ethical decision-making, at least under certain circumstances. Lastly, normative approaches to morality have distinct, underlying neural mechanisms. A disposition or dispositional property is a capacity, ability, or potential to display or exhibit some outcome. Evolvability refers to a disposition to evolve. This chapter discusses why the dispositional nature of evolvability matters—why philosophical distinctions about dispositions can have scientific implications. To that end, we build a conceptual toolkit with vocabulary from prior philosophical analyses using a different disposition: protein foldability. We then apply this toolkit to address several methodological questions related to evolvability. What entities are the bearers of (...) evolvability? What features causally contribute to the disposition of evolvability? How does evolvability manifest? The various possible answers to these questions available from philosophical distinctions suggest key implications for why the concept of evolvability as a disposition is useful in evolutionary research. These include (1) securing scientific virtues (e.g., explanatory depth and generalization, prediction or retrodiction, and control or manipulation) and (2) fostering interdisciplinary collaboration through the coordination of definitional diversity and different types of inquiry. Together these facilitate concentration on a variety of research questions at different levels of organization and on distinct time scales, all of which should be expected for a complex dispositional property such as evolvability. The expansion of livestock production throughout the world has led to increased demand for high protein animal feed. This expansion has created economic benefits for livestock farmers and other actors in the chain, but also resulted in environmental and social side effects. This study aims to identify a set of sustainability issues that cover the environmental, economic and social dimensions of soymeal and beef production chains. The method applied combines the results of multiple studies, including a literature review and stakeholder (...) surveys. Stakeholder surveys were conducted for three different interest groups and two geographical regions . Our results reveal that the selection of issues in most sustainability assessment studies is a relatively arbitrary decision, while the literature also states that identifying issues is an important step in a sustainability assessment. Defining sustainability issues from a whole chain perspective is important, as issues of sustainability emerge at various stages along the production chain, and are found to vary across stakeholders’ interests. Business stakeholders, for example, perceived economic issues to be more important, whereas the majority of consumer stakeholders and other stakeholders perceived social and environmental issues, respectively, to be more important. Different education levels, knowledge, and living patterns in various geographical regions can affect the stakeholders’ perceptions. The combination of a heterogeneous group of stakeholders and the consideration of multiple chain stages constitutes a useful approach to identify sustainability issues along food chains. (shrink)

El insigne filósofo alemán del Siglo XVII, Gottfried Wilhelm Leibniz, plantea el origen del mal como privación. Postula la existencia del mal metafísico, el mal moral y el mal físico. Este ensayo se refiere, básicamente al mal metafísico, que es el principal y la causa de que existan los otros dos. Se tomará en consideración el planteamiento del origen del mal en autores como San Agustín, Descartes, y el del Bayle, se hará referencia a autores antiguos como Aristóteles y se (...) tomarán en cuenta también los planteamientos de los autores contemporáneos a Leibniz como Spinoza y Hobbes. El origen del mal metafísico como limitación o privación en la criatura como algo inevitable porque ésta no es Dios, corresponde a una línea de pensamiento cristiano que se encuentra en San Agustín, Santo Tomás y Descartes, principalmente. En estos filósofos, encontramos el origen del mal en el status ontológico de la criatura. Lo que es propio de Leibniz es justificar este mundo como el mejor de los mundos partiendo de los mundos posibles que había en el entendimiento de Dios, de los cuales Dios escoge el mejor. (shrink)

Before military action, and even before mobilization, the decision on whether to go to war is debated by politicians, pundits, and the public. As they address the right or wrong of such action, it is also a time when, in the language of the just war tradition, the wise would deeply investigate their true claim to jus ad bellum (“the right of war”). Wars have negative consequences, not the least impinging on human life, and offer infrequent and uncertain benefits, yet (...) war is part of the human condition. James G. Murphy’s insightful analysis of the jus ad bellum criteria—competent authority, just cause, right intention, probability of success, last resort, and proportionality—is grounded in a variety of contemporary examples from World War I through Vietnam, the "soccer war" between Honduras and El Salvador, Afghanistan, and the Middle East conflict. Murphy argues persuasively that understanding jus ad bellum requires a primary focus on the international common good and the good of peace. Only secondarily should the argument about going to war hinge on the right of self-defense; in fact, pursuing the common good requires political action, given that peace is not simply the absence of violence. He moves on to demonstrate the interconnectedness of the jus ad bellum criteria, contending that some criteria depend logically on others—and that competent authority, not just cause, is ultimately the most significant criterion in an analysis of going to war. This timely study will be of special interest to scholars and students in ethics, war and peace, and international affairs. (shrink)

Themes of Christian martyrdom were central to popular political mobilization in El Salvador, as in much of Latin America, during the 1970s and 1980s. The story of Christ's sacrifice provided a powerful narrative for explaining injustice and political violence, a frame for interpretation as well as action during the twelve-year Salvadoran civil war, which ended in 1992 by a negotiated settlement. In the first part of this article we trace the politics of martyrdom and sacrifice through the war. The (...) final sections of the article examine the place of narratives of martyrdom and sacrifice in post-civil war El Salvador. While most Salvadorans today continue to experience high levels of inequality, poverty, and violence, the narratives of martyrdom and sacrifice that animated the revolutionary movements and liberation theology of the 1980s have lost much of their resonance. We suggest that the dispersion of both the perceived sources of, and the imagined solutions to, injustice contribute to the diminution in the importance of Christian narratives of martyrdom and sacrifice in El Salvador today. This paper applies philosophical tools from the causalists/statisticalists debate to the evo-devo idea of variational tendencies as propensities biasing phenotypic change. It contends that variational properties are present in a statistical sense in some population dynamics models, particularly quantitative genetics ones, providing ultimate variational explanations. It further argues that these properties, contrary to some recent views, cannot be subsumed under natural selection. Finally, it advocates for a causalist interpretation of these explanations, where variational statistical properties indirectly refer to evo-devo’s variational (...) propensities. (shrink)

The use of dispositions has been put into question many times in the philosophical literature, especially with regards to how dispositional attributions can be justified. Yet, dispositions are an important part not only of our everyday talk but also of our scientific practices. In this paper, we develop an argument that infers the epistemic justification of dispositional talk from itsindispensability for carrying out basic epistemological projects, and we apply it to the use of dispositions in evolutionary biology. For doing this, (...) we first advocate for a function-based strategy for the epistemic justification of dispositional attributions. We next review the functional role of some key dispositional notions in evolutionary biology, such as fitness and evolvability. Then, we show that alternative non-dispositional substitutes of these dispositions fail to fulfill their roles to the same degree. We conclude that the use of dispositions is justified in evolutionary biology. (shrink)

En este artículo, se analiza la documentación producida por autores franceses o afrancesados, en la cual América y sus procesos de independencia, en particular los hispanoamericanos, ocupan un lugar central. Se localiza un importante corpus documental que incluye libros e impresos periódicos. Algunos de ellos fueron de uso en las escuelas primarias y secundarias francesas, otros circularon entre académicos y profesores universitarios. También se analizan algunos textos provenientes de conmemoraciones americanistas, como discursos de legatarios o personalidades con prestigio político o (...) científico, y textos literarios que concursaron en variados eventos vinculados con las celebraciones y conmemoraciones de la Independencia. A partir de ellos, se proponen cinco ejes de reflexión: primero, desde la perspectiva de las representaciones sociales, políticas y culturales de las independencias hispanoamericanas, donde las preocupaciones investigativas están orientadas a lo que se dice que pasó y menos a lo que pasó. Segundo, la reiteración de la categoría influencia para pensar las relaciones decimonónicas entre América y Francia subraya la originalidad de las ideas ilustradas y la Revolución Francesa; en cambio, las revoluciones hispanoamericanas representarían una de sus consecuencias más o menos distorsionada a este lado del Atlántico. Tercero, el lenguaje hermenéutico de lo que se dice que pasó instituyó mitos políticos modernos, asociados directamente con una revolución exitosa, igualitaria, libertaria y fraterna. Cuarto, en el contexto planetario de las dinámicas de modernización política, “lo francés” debe ser pensado como una parte de los procesos de mundialización de la modernidad. Quinto, el examen social y cultural de la producción intelectual presentada permite una mirada crítica a las historias nacionales o continentales, de tal forma que se puedan comprender mejor los procesos de modernización. The origin of Being as a live concept is one of the most difficult questions in history of metaphysics and ontology. This work analyses the postulate that being is constructed by the interaction of terms. In fact, being and the idea of Being has come from the possibility of relations. It is known that metaphysics and ontology has overestimated think Being like something that never change, a substance unchangeable. Reduce Being as ousía, translated as substance, does not understand central affirmation (...) of Aristotle that “The term “being” is used in various senses, but with reference to one central idea and one definite characteristic, and not as merely a common epithet.”. The usually interpretation of relations make them one of those ways, however the concept of Being is always under a relation. Is reconsidered the role of relations in the basis of ontological thinking, taking the renewal of metaphysics, of the French philosopher Jean Wahl, and postulating that Being as totality is the relation that involves beings, Change and Time. En la vida cotidiana del ejercicio del derecho, ya sea en el campo de la judicatura, ora en el del litigio, bien sea en el de la academia, o en actividades administrativas, es bastante común que se hable de la prueba sumaria; pero desafortunadamente no es común que se tenga plena conciencia de su entidad, alcances y usos conforme a su propia naturaleza. Es preocupante observar la peligrosa y antijurídica ligereza, con la cual se acude a la prueba sumaria; pero (...) no para darle su natural uso, sino para superar omisiones de los sujetos procesales con interés de parte en el cumplimiento de las cargas probatorias. La prueba sumaria es utilizada en forma deliberada para conseguir ciertas ventajas probatorias en el proceso, con evidente desmedro del derecho de prueba de la contraparte, afectación de la garantía de la igualdad real de las partes en el proceso, y conculcación del derecho de defensa en toda su extensión. En realidad, el mal uso de la prueba sumaria implica violar los principios probatorios de necesidad, publicidad, contradicción, legalidad y formalidad de la prueba. En otros términos, la utilización indiscriminada de la prueba sumaria, sin el cuidado y la estrictez exigidos expresamente por el mismo legislador para poder usarla, constituye una manifiesta violación al derecho constitucional fundamental al debido proceso. La mirada del envejecimiento, desde una visión de derechos, tiene como antecedente la Segunda Asamblea Mundial sobre Envejecimiento, de la cual se derivó el Plan Internacional de Acción en Envejecimiento de Madrid, que ha sido un documento clave de seguimiento en las reuniones regionales intergubernamentales y no gubernamentales sobre envejecimiento en la región latinoamericana. Adicionalmente, existen dos instrumentos claves a considerar en las políticas de envejecimiento de la región: el Consenso de Montevideo y la Convención Interamericana para la Protección de (...) los Derechos de las Personas Mayores. En todos estos documentos, se abordan las siguientes áreas prioritarias: la situación económica de las personas mayores; salud y bienestar; y entornos sociales y físicos favorables. En este artículo, se analiza cómo ha sido el tratamiento, en las distintas reuniones regionales, del tema de cuidados, el cual se inserta en el área sobre salud y bienestar, además de discutir cómo se han traducido los distintos señalamientos sobre cuidados en la normativa de México. Como resultado, este ensaio será dividido em três partes: na primeira seção, será desenvolvido um diálogo entre um historiador e um sociólogo, para construir uma breve história da técnica; na segunda seção apresentarei um diálogo sobre o conceito de alienação entre Marx e (...) This article develops a theory of border subjectivity that considers the cybernetic role of narrative structures and mediation in political advocacy aimed at dreamers and DACA recipients. "Cybersujetos” are border subjects who are racialized by cybernetic systems and media narratives, but can resist control by repurposing cultural technologies. In assessing the limitations of journalism, literature, and film as outlets for political advocacy, this article finds that remediated representations of undocumented youth that attempt to expand their political agency can further alienate (...) them. Outdated stereotypes in representation are substituted with a proliferation of diverse but still racialized figures meant to demarcate "exceptional" candidates for naturalization, thus failing to challenge the normative parameters of citizenship itself and the militarized position of the US on the global stage. Es indudable el hecho que el mundo está viviendo una crisis sanitaria (pandemia) de magnitudes catastróficas, en la cual todas las medidas de contención, parecen no ser graves, pues el número de bajas por los efectos devastadores de este virus, conocido como Coronavirus (COVID-19 para la comunidad científica), no para crecer, abandonando a la humanidad en la desesperanza, dolor, luto y pérdida, es por eso, que considero que todos los seres humanos de la forma de pensar que sea, ideología política, (...) tendencia de pensamiento, religión, creencias, área de experticia, etc., competimos con nuestro informe y sentar una opinión en torno a un tema que es de vida o muerte para la humanidad en estos momentos y los filósofos, pesar que muchas veces se muestran como seres alejados del mundo en el ensueño de las elucubraciones y “fantasías” maniqueas, no están exentos del problema y le afectan de la misma forma que cualquiera, pues vive en este mundo y está o no, sumergido en el mismo, debe por ello “llenarse” del presente y la realidad actual y efectiva de los problemas que afectan al mundo aquí y ahora. In this study we examine (1) how a manager’s risk behavior is influenced by developing success (or failure) as an impending settling up deadline to report performance approaches, (2) how willingness to provide transparent accountability is negatively affected by perceived risk and eroding trust, and (3) how others interpret and respond to reduced transparency. As perceptions of high levels of risks suggest a lack of environmental control of a firm’s destiny in contemporary settings, we adopt a historical approach to examine (...) these issues. In this respect we draw on primary sources found in library archives in Spain and Argentina. Our focal case refers to the contract signed and executed between the South Sea Company and Captain José de Salinas (1731–1735) to walk 408 Negroes from Buenos Aires to Potosí and sell them en route or at destination. Drawing on this evidence, we examine how bring about unethical conduct featured by increasingly risky business practices, and how eroding trust conditions lead to only summary record-keeping and delayed reporting. In turn, diminished accountability further undermined trust. Our findings have implications for further research in this area as well as for contemporary cases of accounting failures. (shrink)

What is the relationship between Thailand’s human rights crisis during Prime Minister Thaksin Shinawatra’s leadership and the USA-led post-9/11 war on terror? Why did the human rights situation dramatically deteriorate after the Thaksin regime publicly supported the Bush administration’s war on terror and consequently received US counterterror assistance? This article offers two conceptual arguments that jointly demonstrate a constitutive theoretical explanation, which shows that counterterror and militaristic transnational and national discursive structures enabled the strategy of state repression in Thailand under (...) Thaksin. The first concept refers to strategic localization, which refers to how the Bush administration’s global war on terror—and its consequent overarching emphasis on military security—provided an opportunity for the Thaksin administration to strategically localize the global threat of terrorism in ways that could seem relevant to the local Thai context. The second concept pertains to resource mobilization, which shows how converging US and Thai discourses on military security facilitated Thaksin’s strategy of increased state repression that led to the proliferation of state-led human rights abuses. This research article contributes to the human rights literature in two ways: by highlighting how foreign aid programs and its constitutive political discourses shape recipient countries’ domestic human rights situation and by tracing the macro-political factors that lead to the eventual democratic decay of contemporary Thailand.
